北京市進一步優化營商環境更好服務市場主體實施方案

按照黨中央、國(guo)務院決策部(bu)署,為扎實(shi)做好“六(liu)(liu)穩”工(gong)作,全面(mian)落實(shi)“六(liu)(liu)保”任務,持(chi)續(xu)(xu)深化“放管服(fu)”改革(ge),加快打造市場化法治化國(guo)際(ji)化營商(shang)環境,更大激發市場主體活(huo)力(li),增強發展內生動力(li),為首都經濟高(gao)質量(liang)發展持(chi)續(xu)(xu)注入新(xin)動能,制定本(ben)實(shi)施方案。

一、主(zhu)要(yao)目標

以(yi)建(jian)設(she)國(guo)家服務(wu)業擴(kuo)大開放綜合示范區(qu)和(he)中(zhong)國(guo)(北京)自由貿易試(shi)驗區(qu)(以(yi)下簡稱自貿區(qu))為契機,以(yi)建(jian)設(she)國(guo)家營(ying)商(shang)環(huan)境(jing)創新試(shi)點城(cheng)市(shi)為抓手,進一步聚焦市(shi)場主體關切,以(yi)堅(jian)決清除隱性壁壘(lei)、優化再造(zao)審(shen)批流程、加強事(shi)中(zhong)事(shi)后監管(guan)和(he)加快數(shu)字(zi)政府(fu)建(jian)設(she)為重點,有效推(tui)進重點領域(yu)、關鍵(jian)環(huan)節和(he)突出(chu)問題改(gai)革,認真落(luo)實紓(shu)困(kun)惠企(qi)政策(ce),著力(li)打(da)通政策(ce)落(luo)地“最后一公里”,全力(li)打(da)好營(ying)商(shang)環(huan)境(jing)攻堅(jian)戰,打(da)造(zao)與(yu)高(gao)質(zhi)量發展相適應(ying)的國(guo)際一流營(ying)商(shang)環(huan)境(jing)。

二(er)、主要任(ren)務

(一)營造更加高效的投資建(jian)設環(huan)境

堅持以(yi)告知(zhi)承諾為基礎(chu),進一步深化(hua)投(tou)資(zi)審(shen)批(pi)制度改革,探索創新(xin)投(tou)資(zi)管理服務方式,按照(zhao)項目風險等級實施差異(yi)化(hua)管理,優化(hua)投(tou)資(zi)建(jian)設項目審(shen)批(pi)流程。

1.優化(hua)(hua)投(tou)資(zi)項(xiang)(xiang)(xiang)目(mu)(mu)審批流程(cheng)。一(yi)是以高效辦成(cheng)項(xiang)(xiang)(xiang)目(mu)(mu)前期(qi)(qi)“一(yi)件事(shi)(shi)”為(wei)目(mu)(mu)標,健全項(xiang)(xiang)(xiang)目(mu)(mu)前期(qi)(qi)統(tong)籌推進機制(zhi),制(zhi)定(ding)重(zhong)大項(xiang)(xiang)(xiang)目(mu)(mu)儲備管理辦法,進一(yi)步簡化(hua)(hua)、整合投(tou)資(zi)項(xiang)(xiang)(xiang)目(mu)(mu)報(bao)建手續,不斷精(jing)簡優化(hua)(hua)審批程(cheng)序、審批事(shi)(shi)項(xiang)(xiang)(xiang)、申(shen)報(bao)材料。二(er)是深化(hua)(hua)北京經(jing)濟(ji)技術開發區企業投(tou)資(zi)項(xiang)(xiang)(xiang)目(mu)(mu)承(cheng)(cheng)諾制(zhi)改革,規范企業承(cheng)(cheng)諾事(shi)(shi)項(xiang)(xiang)(xiang),統(tong)一(yi)告知承(cheng)(cheng)諾內容、流程(cheng)和承(cheng)(cheng)諾書格式(shi),并(bing)在中關(guan)村(cun)科(ke)學(xue)城(cheng)、懷柔科(ke)學(xue)城(cheng)、未(wei)來科(ke)學(xue)城(cheng)、自貿(mao)區等重(zhong)點區域復制(zhi)推廣“區域評估+標準地+承(cheng)(cheng)諾制(zhi)+政府配(pei)套”改革經(jing)驗。

2.深入推(tui)進(jin)(jin)規(gui)(gui)(gui)劃(hua)用(yong)地(di)審(shen)批(pi)改革。一(yi)(yi)是(shi)加強規(gui)(gui)(gui)劃(hua)用(yong)地(di)與(yu)政(zheng)府及企業投資(zi)決策的銜(xian)接,加快推(tui)進(jin)(jin)各(ge)(ge)類規(gui)(gui)(gui)劃(hua)數據整(zheng)合,推(tui)動各(ge)(ge)級各(ge)(ge)類規(gui)(gui)(gui)劃(hua)底圖疊合,實(shi)(shi)現各(ge)(ge)部門底圖共享(xiang)、實(shi)(shi)時查詢和(he)業務協同,為政(zheng)府及企業投資(zi)決策提供便利(li)。二是(shi)出臺區(qu)(qu)域(yu)評估實(shi)(shi)施方案(an),明(ming)確(que)環境、水、交(jiao)通等領域(yu)評估的實(shi)(shi)施細則(ze)和(he)技(ji)術要求,對(dui)區(qu)(qu)域(yu)內建(jian)(jian)設(she)項(xiang)目可采取直接準入、告知(zhi)承諾制、容缺受(shou)理等多(duo)種(zhong)方式(shi)簡(jian)化辦理。開展(zhan)“街區(qu)(qu)控(kong)規(gui)(gui)(gui)+區(qu)(qu)域(yu)評估”審(shen)批(pi)改革試點,進(jin)(jin)一(yi)(yi)步簡(jian)化審(shen)批(pi)程序(xu)。三是(shi)進(jin)(jin)一(yi)(yi)步下放(fang)規(gui)(gui)(gui)劃(hua)審(shen)批(pi)權(quan)限,制定房屋建(jian)(jian)筑類、市政(zheng)交(jiao)通基(ji)礎設(she)施類項(xiang)目市區(qu)(qu)兩級審(shen)批(pi)權(quan)限清單,便于企業申報,減(jian)少辦理時間。

3.深化(hua)(hua)工(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)審批制度改(gai)革。一(yi)(yi)是(shi)深入(ru)推(tui)進(jin)(jin)工(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)項(xiang)(xiang)目(mu)分(fen)(fen)級(ji)分(fen)(fen)類(lei)管(guan)理,精簡規范工(gong)程(cheng)(cheng)建(jian)(jian)設(she)(she)(she)項(xiang)(xiang)目(mu)全(quan)流(liu)程(cheng)(cheng)涉及的審批事項(xiang)(xiang)、技術審查(cha)和(he)中(zhong)介服務事項(xiang)(xiang)。二是(shi)在確(que)(que)保安全(quan)的前提(ti)下,對(dui)于社會(hui)投(tou)資低(di)風(feng)險(xian)(xian)新建(jian)(jian)、改(gai)擴建(jian)(jian)項(xiang)(xiang)目(mu)施(shi)工(gong)許可實行(xing)(xing)告知承諾(nuo)制。三是(shi)全(quan)面推(tui)進(jin)(jin)“多(duo)測(ce)合(he)一(yi)(yi)”,優化(hua)(hua)整合(he)用地(di)、規劃、施(shi)工(gong)、驗收、不動(dong)(dong)產(chan)登記(ji)等(deng)(deng)(deng)階段測(ce)繪(hui)事項(xiang)(xiang),對(dui)同(tong)一(yi)(yi)標(biao)的物的測(ce)繪(hui)成果(guo)有關部門共享互認,減(jian)少(shao)對(dui)企(qi)業測(ce)繪(hui)次(ci)數(shu)。四是(shi)出(chu)臺(tai)建(jian)(jian)筑師負責制指導意見(jian),針對(dui)民(min)用建(jian)(jian)筑和(he)低(di)風(feng)險(xian)(xian)工(gong)業建(jian)(jian)筑項(xiang)(xiang)目(mu)試點推(tui)行(xing)(xing)免(mian)除施(shi)工(gong)圖(tu)設(she)(she)(she)計審查(cha)、規劃驗線、施(shi)工(gong)放線復驗等(deng)(deng)(deng)手(shou)續(xu)。五是(shi)公開地(di)質(zhi)(zhi)災害(hai)易發區分(fen)(fen)布圖(tu)、各區域地(di)質(zhi)(zhi)條件與地(di)質(zhi)(zhi)災害(hai)防治(zhi)要求(qiu)等(deng)(deng)(deng)信息(xi),為(wei)企(qi)業自(zi)主開展初步勘察設(she)(she)(she)計提(ti)供便利(li)。六是(shi)搭建(jian)(jian)亚博游戏工(gong)程(cheng)(cheng)質(zhi)(zhi)量風(feng)險(xian)(xian)分(fen)(fen)級(ji)管(guan)控平臺(tai),根據風(feng)險(xian)(xian)等(deng)(deng)(deng)級(ji)確(que)(que)定質(zhi)(zhi)量安全(quan)監(jian)督檢(jian)查(cha)頻(pin)次(ci)和(he)內容,低(di)風(feng)險(xian)(xian)項(xiang)(xiang)目(mu)只進(jin)(jin)行(xing)(xing)1次(ci)檢(jian)查(cha)。七是(shi)深化(hua)(hua)工(gong)程(cheng)(cheng)竣工(gong)驗收“多(duo)驗合(he)一(yi)(yi)”改(gai)革,建(jian)(jian)立工(gong)程(cheng)(cheng)竣工(gong)聯合(he)驗收服務平臺(tai),優化(hua)(hua)聯合(he)竣工(gong)驗收流(liu)程(cheng)(cheng)。推(tui)行(xing)(xing)低(di)風(feng)險(xian)(xian)項(xiang)(xiang)目(mu)不動(dong)(dong)產(chan)登記(ji)和(he)聯合(he)驗收合(he)并辦理,進(jin)(jin)一(yi)(yi)步壓減(jian)首次(ci)登記(ji)時限。

4.全(quan)面(mian)提升市政(zheng)服務(wu)水(shui)平。一(yi)(yi)是(shi)明(ming)確(que)工(gong)程(cheng)建設(she)項(xiang)(xiang)目水(shui)、電(dian)、氣、熱、通(tong)信、有線電(dian)視(shi)等市政(zheng)接(jie)(jie)(jie)(jie)(jie)入(ru)(ru)標準,簡化市政(zheng)接(jie)(jie)(jie)(jie)(jie)入(ru)(ru)審(shen)(shen)(shen)批流程(cheng),降(jiang)低接(jie)(jie)(jie)(jie)(jie)入(ru)(ru)成本(ben)(ben)。二是(shi)深化市政(zheng)設(she)施(shi)(shi)接(jie)(jie)(jie)(jie)(jie)入(ru)(ru)審(shen)(shen)(shen)批改(gai)(gai)革(ge),對(dui)涉及的工(gong)程(cheng)規(gui)劃許(xu)可(ke)(ke)、綠化許(xu)可(ke)(ke)、占道施(shi)(shi)工(gong)許(xu)可(ke)(ke)等環節實行(xing)并(bing)聯審(shen)(shen)(shen)批,探索實行(xing)接(jie)(jie)(jie)(jie)(jie)入(ru)(ru)告知承諾制(zhi)(zhi);取(qu)消水(shui)、電(dian)、氣、熱、通(tong)信、有線電(dian)視(shi)等市政(zheng)接(jie)(jie)(jie)(jie)(jie)入(ru)(ru)報(bao)裝(zhuang)過(guo)程(cheng)中的附(fu)加審(shen)(shen)(shen)批要件和手續。三是(shi)研究推進市政(zheng)“一(yi)(yi)站式”全(quan)程(cheng)便捷(jie)服務(wu),加快實現(xian)報(bao)裝(zhuang)、查詢(xun)、繳費等業務(wu)“全(quan)程(cheng)網辦(ban)”,申請人僅在(zai)線提供(gong)規(gui)劃許(xu)可(ke)(ke)證、產權證、身份證件等信息即(ji)可(ke)(ke)辦(ban)理市政(zheng)接(jie)(jie)(jie)(jie)(jie)入(ru)(ru)業務(wu)。四是(shi)落實市政(zheng)接(jie)(jie)(jie)(jie)(jie)入(ru)(ru)項(xiang)(xiang)目“非禁(jin)免批”改(gai)(gai)革(ge),進一(yi)(yi)步(bu)細化公(gong)開禁(jin)止(zhi)區(qu)域(yu)(yu)范圍,針對(dui)5G基(ji)站接(jie)(jie)(jie)(jie)(jie)電(dian)項(xiang)(xiang)目在(zai)禁(jin)止(zhi)區(qu)域(yu)(yu)外免除占掘(jue)路審(shen)(shen)(shen)批。五(wu)是(shi)對(dui)符合條(tiao)件的充換(huan)電(dian)設(she)施(shi)(shi)接(jie)(jie)(jie)(jie)(jie)入(ru)(ru)外電(dian)源實行(xing)免費制(zhi)(zhi),降(jiang)低高壓接(jie)(jie)(jie)(jie)(jie)電(dian)成本(ben)(ben)。

5.加快(kuai)推動工程(cheng)建(jian)設項(xiang)目全流程(cheng)在線審(shen)(shen)批。一(yi)是(shi)完善(shan)工程(cheng)建(jian)設項(xiang)目審(shen)(shen)批系(xi)(xi)統(tong),推進與(yu)“多規合一(yi)”、施工圖聯審(shen)(shen)、聯合驗(yan)收(shou)、監督檢查、信用(yong)公示等(deng)系(xi)(xi)統(tong)信息共享和業(ye)務(wu)(wu)協同(tong),企業(ye)信息一(yi)次填報、材料一(yi)次上傳,部門(men)評(ping)審(shen)(shen)意見和審(shen)(shen)批結果實時推送,批復文件等(deng)在線打印(yin)。二是(shi)將工程(cheng)建(jian)設項(xiang)目涉及的行政許(xu)可、備案、評(ping)估評(ping)審(shen)(shen)、中介服務(wu)(wu)、市政公用(yong)服務(wu)(wu)等(deng)事項(xiang)納入(ru)工程(cheng)建(jian)設項(xiang)目審(shen)(shen)批系(xi)(xi)統(tong),公開辦理(li)標準(zhun)和費(fei)用(yong)。

(二(er))營(ying)造更加便利的市場環境

以市場(chang)主體需求為導(dao)向,在商事制度、融資(zi)信貸(dai)、招標投(tou)標等(deng)方(fang)面持續深化改革,為市場(chang)主體從事生產經營活(huo)動創造國際一流的發展環(huan)境。

1.進一步降低市場準入門檻。一是(shi)全面梳理(li)工程(cheng)建設(she)、教育、醫療(liao)、體育等(deng)(deng)領(ling)域(yu)準入事項(xiang),明確事項(xiang)名稱、申請條(tiao)件(jian)(jian)和材料、辦(ban)(ban)(ban)理(li)流程(cheng)等(deng)(deng)內(nei)容(rong)并向社(she)(she)會(hui)公開;對企(qi)(qi)業(ye)(ye)資(zi)質、資(zi)金、股比、人(ren)員(yuan)、場所等(deng)(deng)設(she)置的(de)(de)不合理(li)條(tiao)件(jian)(jian)要立即清理(li)。二是(shi)優化診所和藥店(dian)開設(she)審(shen)批(pi),對符合條(tiao)件(jian)(jian)的(de)(de)診所執(zhi)業(ye)(ye)登記實行備(bei)案制管(guan)(guan)理(li);對社(she)(she)會(hui)辦(ban)(ban)(ban)醫療(liao)機構(gou)乙類大型醫用(yong)設(she)備(bei)配置許可和只(zhi)經(jing)營乙類非(fei)處(chu)方藥零(ling)售(shou)企(qi)(qi)業(ye)(ye)開設(she)實行告(gao)知(zhi)承諾制。三是(shi)取(qu)消藥品零(ling)售(shou)企(qi)(qi)業(ye)(ye)籌建審(shen)批(pi),清理(li)對開辦(ban)(ban)(ban)藥店(dian)設(she)定的(de)(de)間(jian)距限制等(deng)(deng)不合理(li)條(tiao)件(jian)(jian)。四(si)是(shi)在自貿區推(tui)行食品經(jing)營(僅(jin)銷售(shou)預包裝食品)備(bei)案制。五是(shi)通(tong)過營業(ye)(ye)性演(yan)出在線(xian)審(shen)批(pi)系統實現(xian)跨區演(yan)出信息共(gong)享,對于(yu)獲得全國(guo)各級(ji)文化和旅游主管(guan)(guan)部門批(pi)準的(de)(de)營業(ye)(ye)性演(yan)出等(deng)(deng)項(xiang)目,在批(pi)準舉(ju)辦(ban)(ban)(ban)日(ri)期起(qi)一年內(nei)再次申請舉(ju)辦(ban)(ban)(ban),實行事前(qian)備(bei)案管(guan)(guan)理(li),原(yuan)則上(shang)不再重復審(shen)批(pi)。

2.優化(hua)新業態新模式(shi)市(shi)場準(zhun)入(ru)(ru)(ru)環境。針對(dui)數字經(jing)濟(ji)領域(yu)市(shi)場準(zhun)入(ru)(ru)(ru)事項(xiang)數量多、條件高(gao)(gao)、手(shou)續繁等(deng)(deng)問(wen)題,研究(jiu)提出(chu)(chu)放寬數字經(jing)濟(ji)領域(yu)市(shi)場準(zhun)入(ru)(ru)(ru)的改(gai)革措施。一是(shi)對(dui)新業態新模式(shi)涉及(ji)的行政許可,全(quan)部納入(ru)(ru)(ru)政務(wu)服(fu)務(wu)事項(xiang)清(qing)單并(bing)向社會公開(kai),將電(dian)競(jing)賽事、互(hu)(hu)聯(lian)(lian)網(wang)醫療相關審批(pi)事項(xiang)納入(ru)(ru)(ru)市(shi)、區兩級(ji)政務(wu)服(fu)務(wu)大廳綜合(he)窗口。二是(shi)支持電(dian)競(jing)賽事在(zai)(zai)京發展(zhan)(zhan),簡化(hua)電(dian)競(jing)賽事審批(pi),將賽事許可和(he)(he)安全(quan)許可合(he)并(bing)辦理,實現一次申報、并(bing)聯(lian)(lian)審批(pi);依(yi)據(ju)體(ti)育主管(guan)部門出(chu)(chu)具的參(can)加電(dian)競(jing)賽事運動員身份確認函,為(wei)境外(wai)參(can)賽人員提供簽證(zheng)(zheng)便利(li)化(hua)服(fu)務(wu)。三是(shi)優化(hua)互(hu)(hu)聯(lian)(lian)網(wang)醫療發展(zhan)(zhan)環境,鼓(gu)勵(li)(li)支持醫療機(ji)(ji)構(gou)對(dui)接(jie)互(hu)(hu)聯(lian)(lian)網(wang)平臺,市(shi)場主體(ti)可以同(tong)(tong)步申請設(she)立實體(ti)醫療機(ji)(ji)構(gou)和(he)(he)互(hu)(hu)聯(lian)(lian)網(wang)醫院,實現“同(tong)(tong)審批(pi)、同(tong)(tong)發證(zheng)(zheng)”;推(tui)動開(kai)展(zhan)(zhan)互(hu)(hu)聯(lian)(lian)網(wang)復(fu)診、健康咨(zi)詢、遠(yuan)程輔助診斷等(deng)(deng)服(fu)務(wu),探索根據(ju)病種分級(ji)分類實施互(hu)(hu)聯(lian)(lian)網(wang)問(wen)診管(guan)理,實現線上咨(zi)詢、線下診療銜接(jie)。四是(shi)促進(jin)在(zai)(zai)線教(jiao)(jiao)育健康有序發展(zhan)(zhan),進(jin)一步明(ming)(ming)確校(xiao)外(wai)在(zai)(zai)線教(jiao)(jiao)育備(bei)(bei)案審查時限(xian)和(he)(he)標(biao)準(zhun),持續更新亚博游(you)戏校(xiao)外(wai)在(zai)(zai)線教(jiao)(jiao)育備(bei)(bei)案名單。五是(shi)提高(gao)(gao)自動駕駛測試(shi)(shi)效率和(he)(he)透明(ming)(ming)度,推(tui)動自動駕駛封(feng)閉(bi)場地(di)測試(shi)(shi)結果異地(di)通(tong)用互(hu)(hu)認,向社會公開(kai)封(feng)閉(bi)場地(di)測試(shi)(shi)服(fu)務(wu)項(xiang)目及(ji)收(shou)費標(biao)準(zhun)并(bing)進(jin)行監(jian)管(guan);簡化(hua)自動駕駛測試(shi)(shi)通(tong)知書(shu)申領和(he)(he)續發手(shou)續,對(dui)測試(shi)(shi)通(tong)知書(shu)到期(qi)但車輛(liang)狀態未改(gai)變的無需重(zhong)復(fu)測試(shi)(shi),直接(jie)延長期(qi)限(xian)。六是(shi)優化(hua)網(wang)約(yue)車行業市(shi)場準(zhun)入(ru)(ru)(ru)制度,出(chu)(chu)臺亚博游(you)戏深化(hua)巡(xun)游(you)出(chu)(chu)租車與網(wang)約(yue)車融合(he)發展(zhan)(zhan)改(gai)革方案,鼓(gu)勵(li)(li)巡(xun)游(you)出(chu)(chu)租車開(kai)展(zhan)(zhan)網(wang)約(yue)服(fu)務(wu);推(tui)動公安、交通(tong)等(deng)(deng)部門數據(ju)共(gong)享,實現網(wang)約(yue)車運輸證(zheng)(zheng)“全(quan)程網(wang)辦”。七是(shi)加快網(wang)絡游(you)戲版號審批(pi),擴充游(you)戲審讀(du)專家隊伍(wu),對(dui)疫情(qing)期(qi)間(jian)出(chu)(chu)版的抗擊疫情(qing)、休(xiu)閑益智等(deng)(deng)不含收(shou)費、廣告內容的游(you)戲產品實施先上線后備(bei)(bei)案管(guan)理。

3.深(shen)化“證照(zhao)(zhao)(zhao)分離(li)”改(gai)革(ge)。一是(shi)(shi)著(zhu)力(li)(li)(li)破解“準(zhun)(zhun)入(ru)不準(zhun)(zhun)營(ying)”難題(ti),按(an)照(zhao)(zhao)(zhao)國家“證照(zhao)(zhao)(zhao)分離(li)”改(gai)革(ge)全(quan)覆蓋試(shi)點要求,全(quan)面清理(li)涉(she)企(qi)經營(ying)許(xu)(xu)可事(shi)(shi)項(xiang)(xiang),對全(quan)市所(suo)有涉(she)企(qi)經營(ying)許(xu)(xu)可事(shi)(shi)項(xiang)(xiang)實(shi)行(xing)(xing)清單管理(li)并(bing)向(xiang)社(she)會公布;清單之外不得(de)限制企(qi)業(ye)(ye)(ye)進入(ru)相關行(xing)(xing)業(ye)(ye)(ye)或領域,企(qi)業(ye)(ye)(ye)取(qu)得(de)營(ying)業(ye)(ye)(ye)執照(zhao)(zhao)(zhao)即可自主(zhu)開(kai)展(zhan)一般性經營(ying)。二是(shi)(shi)著(zhu)力(li)(li)(li)推(tui)進“照(zhao)(zhao)(zhao)后(hou)減證”和簡化審(shen)批,2021年底前取(qu)消審(shen)批、改(gai)為備(bei)案或實(shi)行(xing)(xing)告知承諾的事(shi)(shi)項(xiang)(xiang)力(li)(li)(li)爭達到100項(xiang)(xiang)以上(shang),自貿(mao)區范圍(wei)內力(li)(li)(li)爭達到150項(xiang)(xiang)。三是(shi)(shi)開(kai)展(zhan)食品類相關許(xu)(xu)可事(shi)(shi)項(xiang)(xiang)“證照(zhao)(zhao)(zhao)聯辦”改(gai)革(ge)試(shi)點,實(shi)現(xian)企(qi)業(ye)(ye)(ye)營(ying)業(ye)(ye)(ye)執照(zhao)(zhao)(zhao)和行(xing)(xing)政許(xu)(xu)可一次申請(qing)、并(bing)聯審(shen)批。四是(shi)(shi)著(zhu)力(li)(li)(li)解決市場(chang)(chang)準(zhun)(zhun)入(ru)多頭審(shen)批、重復(fu)審(shen)批問(wen)題(ti),在北京經濟技術開(kai)發區開(kai)展(zhan)“一業(ye)(ye)(ye)一證”改(gai)革(ge)試(shi)點,并(bing)逐步向(xiang)自貿(mao)區推(tui)廣,實(shi)現(xian)“一證準(zhun)(zhun)營(ying)”。五(wu)是(shi)(shi)落實(shi)“一照(zhao)(zhao)(zhao)多址(zhi)”改(gai)革(ge),市場(chang)(chang)主(zhu)體已(yi)公示其(qi)分支機構實(shi)際(ji)經營(ying)場(chang)(chang)所(suo)或在營(ying)業(ye)(ye)(ye)執照(zhao)(zhao)(zhao)注明分支機構住所(suo)的,各審(shen)批部門應依法(fa)為其(qi)分支機構辦理(li)相關許(xu)(xu)可事(shi)(shi)項(xiang)(xiang)審(shen)批手續。

4.持續(xu)改(gai)善(shan)中(zhong)(zhong)(zhong)(zhong)小(xiao)微(wei)企業(ye)(ye)融(rong)(rong)資(zi)環境(jing)。重點圍繞中(zhong)(zhong)(zhong)(zhong)小(xiao)微(wei)企業(ye)(ye)信(xin)用(yong)評價、擔保(bao)、質押(ya)、信(xin)貸(dai)(dai)(dai)、創業(ye)(ye)投(tou)資(zi)等重點環節(jie),提(ti)供更加便利(li)、更加優惠的融(rong)(rong)資(zi)服(fu)(fu)(fu)務(wu)(wu)。一是(shi)(shi)鼓(gu)勵(li)(li)銀行、擔保(bao)機(ji)構(gou)制定完(wan)善(shan)經營指標(biao)評價、貸(dai)(dai)(dai)款(kuan)(kuan)盡職免責標(biao)準和(he)流(liu)程,創新對中(zhong)(zhong)(zhong)(zhong)小(xiao)微(wei)企業(ye)(ye)的信(xin)貸(dai)(dai)(dai)服(fu)(fu)(fu)務(wu)(wu)模式,全面推(tui)行線上服(fu)(fu)(fu)務(wu)(wu)。二是(shi)(shi)發揮北京知(zhi)(zhi)識產(chan)(chan)權(quan)交易中(zhong)(zhong)(zhong)(zhong)心作(zuo)用(yong),為科技(ji)型中(zhong)(zhong)(zhong)(zhong)小(xiao)微(wei)企業(ye)(ye)提(ti)供知(zhi)(zhi)識產(chan)(chan)權(quan)登記和(he)交易等全鏈條服(fu)(fu)(fu)務(wu)(wu),年服(fu)(fu)(fu)務(wu)(wu)科技(ji)型中(zhong)(zhong)(zhong)(zhong)小(xiao)微(wei)企業(ye)(ye)不(bu)少(shao)于5000家。三是(shi)(shi)鼓(gu)勵(li)(li)金融(rong)(rong)機(ji)構(gou)加強與(yu)知(zhi)(zhi)識產(chan)(chan)權(quan)中(zhong)(zhong)(zhong)(zhong)介(jie)機(ji)構(gou)合作(zuo),開發金融(rong)(rong)產(chan)(chan)品,提(ti)高融(rong)(rong)資(zi)規模,亚博(bo)游戏新發放知(zhi)(zhi)識產(chan)(chan)權(quan)質押(ya)貸(dai)(dai)(dai)款(kuan)(kuan)額力爭同(tong)比增長30%以上。四是(shi)(shi)鼓(gu)勵(li)(li)稅務(wu)(wu)、人(ren)力資(zi)源社會保(bao)障等部門(men)和(he)公共(gong)服(fu)(fu)(fu)務(wu)(wu)企業(ye)(ye)建立信(xin)用(yong)評價標(biao)準和(he)指標(biao)體系,加強與(yu)金融(rong)(rong)機(ji)構(gou)數據信(xin)息(xi)歸集共(gong)享,引導金融(rong)(rong)機(ji)構(gou)加強信(xin)用(yong)貸(dai)(dai)(dai)款(kuan)(kuan)產(chan)(chan)品創新,小(xiao)微(wei)企業(ye)(ye)信(xin)用(yong)貸(dai)(dai)(dai)款(kuan)(kuan)余(yu)額占比不(bu)低于30%。五(wu)是(shi)(shi)出(chu)臺中(zhong)(zhong)(zhong)(zhong)小(xiao)微(wei)企業(ye)(ye)首(shou)次貸(dai)(dai)(dai)款(kuan)(kuan)貼息(xi)指導意見,對在市首(shou)貸(dai)(dai)(dai)中(zhong)(zhong)(zhong)(zhong)心辦理貸(dai)(dai)(dai)款(kuan)(kuan)業(ye)(ye)務(wu)(wu)的中(zhong)(zhong)(zhong)(zhong)小(xiao)微(wei)企業(ye)(ye)進行貼息(xi);市續(xu)貸(dai)(dai)(dai)中(zhong)(zhong)(zhong)(zhong)心推(tui)行網上受理、無還(huan)本續(xu)貸(dai)(dai)(dai)等服(fu)(fu)(fu)務(wu)(wu)。六是(shi)(shi)建設(she)股(gu)權(quan)投(tou)資(zi)和(he)創業(ye)(ye)投(tou)資(zi)份額轉讓平臺,為私募股(gu)權(quan)持有人(ren)提(ti)供短期(qi)的流(liu)動性支持和(he)規范的退(tui)出(chu)渠道。

5.深化政(zheng)府采購(gou)(gou)和招(zhao)(zhao)標(biao)(biao)(biao)投標(biao)(biao)(biao)改革。一是建立全(quan)市統一的(de)(de)全(quan)流(liu)(liu)程(cheng)電子化政(zheng)府采購(gou)(gou)平(ping)臺(tai),完善在(zai)線(xian)招(zhao)(zhao)投標(biao)(biao)(biao)、采購(gou)(gou)評(ping)審、合(he)同簽訂、履(lv)約驗收、信用評(ping)價、資(zi)金(jin)支(zhi)付功能。二(er)是將政(zheng)府集中采購(gou)(gou)供應商一次招(zhao)(zhao)標(biao)(biao)(biao)入圍改為(wei)不定期備案(an),增加企業(ye)參與機(ji)會。三(san)是研究建立公(gong)(gong)(gong)共(gong)(gong)資(zi)源(yuan)(yuan)交(jiao)易(yi)(yi)(yi)統一管(guan)理服(fu)務(wu)機(ji)構,形成組織架構科(ke)學、管(guan)辦分離(li)、服(fu)務(wu)高效、監(jian)管(guan)規范的(de)(de)工作體(ti)系(xi)。四是建立完善統一規范、全(quan)流(liu)(liu)程(cheng)電子化的(de)(de)公(gong)(gong)(gong)共(gong)(gong)資(zi)源(yuan)(yuan)交(jiao)易(yi)(yi)(yi)平(ping)臺(tai)體(ti)系(xi),推進(jin)各類交(jiao)易(yi)(yi)(yi)、主體(ti)、履(lv)約、信用、監(jian)管(guan)等數據信息共(gong)(gong)享,推動(dong)各部門在(zai)同一平(ping)臺(tai)監(jian)管(guan),為(wei)市場(chang)主體(ti)營造公(gong)(gong)(gong)開透明、高效便利、公(gong)(gong)(gong)平(ping)競爭的(de)(de)交(jiao)易(yi)(yi)(yi)環境。五是加快(kuai)推動(dong)公(gong)(gong)(gong)共(gong)(gong)資(zi)源(yuan)(yuan)招(zhao)(zhao)投標(biao)(biao)(biao)交(jiao)易(yi)(yi)(yi)系(xi)統改造升(sheng)級,實(shi)現項目進(jin)場(chang)登(deng)記(ji)、招(zhao)(zhao)標(biao)(biao)(biao)、投標(biao)(biao)(biao)、開標(biao)(biao)(biao)、評(ping)標(biao)(biao)(biao)、定標(biao)(biao)(biao)、合(he)同履(lv)約管(guan)理、合(he)同款項支(zhi)付等全(quan)流(liu)(liu)程(cheng)電子化。六是加快(kuai)實(shi)現各交(jiao)易(yi)(yi)(yi)系(xi)統與公(gong)(gong)(gong)共(gong)(gong)資(zi)源(yuan)(yuan)交(jiao)易(yi)(yi)(yi)金(jin)融擔保(bao)服(fu)務(wu)平(ping)臺(tai)對接,提(ti)供在(zai)線(xian)提(ti)交(jiao)投標(biao)(biao)(biao)保(bao)證金(jin)、履(lv)約保(bao)證金(jin)等服(fu)務(wu);大力推行金(jin)融機(ji)構電子保(bao)函替(ti)代現金(jin)繳納涉企保(bao)證金(jin),減輕企業(ye)現金(jin)流(liu)(liu)壓力。

(三(san))營造(zao)更加開放的外資外貿環境(jing)

推(tui)動投資貿易自由化(hua)、便利化(hua),建(jian)立(li)與國際規則相銜接的貿易監(jian)管體系(xi),采取有效措施吸引(yin)外資企業(ye)在京發展(zhan)。

1.進一步提(ti)(ti)高(gao)進出(chu)口(kou)(kou)通關效率。一是實現進口(kou)(kou)、出(chu)口(kou)(kou)整體通關時(shi)間分別壓縮至30小時(shi)以(yi)下和(he)11小時(shi)以(yi)下。二是深(shen)入推(tui)(tui)進“提(ti)(ti)前(qian)申(shen)報”“兩(liang)步申(shen)報”,保(bao)障企(qi)業(ye)(ye)進口(kou)(kou)貨物“船邊直(zhi)提(ti)(ti)”作業(ye)(ye)效率,壓縮整體通關時(shi)間。三是優化(hua)風(feng)險布控規(gui)則,降低守法(fa)企(qi)業(ye)(ye)和(he)低風(feng)險商品查(cha)(cha)(cha)驗(yan)(yan)(yan)率。固(gu)化(hua)疫情期間海關便(bian)企(qi)查(cha)(cha)(cha)驗(yan)(yan)(yan)措施(shi),繼續實施(shi)預約、延時(shi)、下廠、入庫等(deng)“靈活查(cha)(cha)(cha)驗(yan)(yan)(yan)”方式(shi),允許企(qi)業(ye)(ye)采取委(wei)托或不到(dao)場等(deng)“無陪同查(cha)(cha)(cha)驗(yan)(yan)(yan)”方式(shi),減少貨物搬倒和(he)查(cha)(cha)(cha)驗(yan)(yan)(yan)時(shi)間。四是創新推(tui)(tui)進京津海關高(gao)級認證企(qi)業(ye)(ye)便(bian)利化(hua)措施(shi)互認,實現兩(liang)地高(gao)級認證企(qi)業(ye)(ye)免擔保(bao)等(deng)優惠待遇跨(kua)關區共享。五(wu)是提(ti)(ti)高(gao)亚(ya)博游(you)戏(xi)航空貨運(yun)中轉效率,提(ti)(ti)升國際(ji)郵件分揀能力。

2.減(jian)輕進出口企(qi)(qi)業(ye)(ye)負擔。一是打造公(gong)開、透明的(de)(de)口岸(an)通關(guan)(guan)環境,引導企(qi)(qi)業(ye)(ye)主動(dong)(dong)披(pi)露違(wei)規行為,降低通關(guan)(guan)成(cheng)本,口岸(an)通關(guan)(guan)綜合費(fei)用壓縮20%以(yi)上。二(er)是線上線下同(tong)步公(gong)開空港(gang)口岸(an)經營(ying)服(fu)務(wu)收(shou)費(fei)清(qing)單,實現收(shou)費(fei)項目定期更(geng)新(xin)、在(zai)線查詢,做到清(qing)單之外無收(shou)費(fei)。三是提高外貿企(qi)(qi)業(ye)(ye)資(zi)金(jin)周轉率(lv),將辦理出口退(tui)稅業(ye)(ye)務(wu)平均(jun)時間壓減(jian)至(zhi)6個工作日以(yi)內;全面(mian)推(tui)行出口退(tui)稅無紙化。四是對于主動(dong)(dong)報告(gao)存在(zai)涉及關(guan)(guan)稅違(wei)規情況的(de)(de)企(qi)(qi)業(ye)(ye),經確認屬于企(qi)(qi)業(ye)(ye)主動(dong)(dong)披(pi)露處(chu)置范圍的(de)(de),可從輕、減(jian)輕或免(mian)予行政處(chu)罰;企(qi)(qi)業(ye)(ye)在(zai)貨物(wu)放(fang)行后通過自查發現少繳(jiao)(jiao)、漏繳(jiao)(jiao)稅款,主動(dong)(dong)披(pi)露并補繳(jiao)(jiao)的(de)(de),可依法(fa)減(jian)免(mian)稅款滯(zhi)納(na)金(jin)。

3.拓展(zhan)國際貿易“單(dan)一(yi)窗(chuang)(chuang)口(kou)(kou)(kou)”功能。加(jia)快(kuai)“單(dan)一(yi)窗(chuang)(chuang)口(kou)(kou)(kou)”功能由口(kou)(kou)(kou)岸通(tong)(tong)關(guan)(guan)(guan)執法向物流(liu)(liu)(liu)、貿易服務(wu)(wu)等(deng)(deng)全鏈(lian)條擴展(zhan)。一(yi)是(shi)在“單(dan)一(yi)窗(chuang)(chuang)口(kou)(kou)(kou)”平臺增設跨境貿易中(zhong)介(jie)機構服務(wu)(wu)功能,進出口(kou)(kou)(kou)企(qi)業(ye)可以(yi)對(dui)中(zhong)介(jie)機構開(kai)展(zhan)服務(wu)(wu)評價,并(bing)公布評價結果(guo)和進口(kou)(kou)(kou)報(bao)關(guan)(guan)(guan)業(ye)務(wu)(wu)前(qian)100名中(zhong)介(jie)機構通(tong)(tong)關(guan)(guan)(guan)時間,不(bu)斷規范和提高服務(wu)(wu)水平。二是(shi)利用(yong)(yong)區塊鏈(lian)技術完善北京空(kong)港(gang)國際物流(liu)(liu)(liu)應用(yong)(yong)系(xi)統和京津冀海(hai)(hai)運通(tong)(tong)關(guan)(guan)(guan)物流(liu)(liu)(liu)查詢(xun)系(xi)統,推(tui)進首都機場智(zhi)慧空(kong)港(gang)口(kou)(kou)(kou)岸全流(liu)(liu)(liu)程、全環節、全鏈(lian)條、無(wu)紙化作業(ye);推(tui)動(dong)天(tian)津港(gang)、河(he)北唐山(shan)港(gang)等(deng)(deng)地通(tong)(tong)關(guan)(guan)(guan)物流(liu)(liu)(liu)數據(ju)上(shang)鏈(lian),為企(qi)業(ye)提供“通(tong)(tong)關(guan)(guan)(guan)+物流(liu)(liu)(liu)”實(shi)(shi)時查詢(xun)服務(wu)(wu)。三是(shi)強化商務(wu)(wu)、稅務(wu)(wu)、海(hai)(hai)關(guan)(guan)(guan)、人民(min)銀(yin)行(xing)(xing)、外匯等(deng)(deng)部門數據(ju)共(gong)享,推(tui)動(dong)銀(yin)行(xing)(xing)、保(bao)(bao)險(xian)(xian)等(deng)(deng)金(jin)融機構利用(yong)(yong)“單(dan)一(yi)窗(chuang)(chuang)口(kou)(kou)(kou)”大數據(ju)精(jing)準分析,為企(qi)業(ye)快(kuai)速(su)提供關(guan)(guan)(guan)稅保(bao)(bao)函、關(guan)(guan)(guan)稅保(bao)(bao)證(zheng)保(bao)(bao)險(xian)(xian)等(deng)(deng)金(jin)融產品,減輕企(qi)業(ye)現金(jin)流(liu)(liu)(liu)壓力。四是(shi)開(kai)通(tong)(tong)報(bao)關(guan)(guan)(guan)綠色通(tong)(tong)道,為2022年冬奧會、冬殘奧會等(deng)(deng)國際活動(dong)設立物資通(tong)(tong)關(guan)(guan)(guan)服務(wu)(wu)專區,實(shi)(shi)現即查即放。

(四)營造更加穩定的(de)就(jiu)業環境

加大力(li)度(du)穩定和擴大就業(ye),破除影響(xiang)就業(ye)的各種不合理限制(zhi),適應并促進多元化的新就業(ye)形態,推動企業(ye)技能人才自主(zhu)評價,因地制(zhi)宜(yi)發展靈活就業(ye)、共(gong)享(xiang)用工,進一步提升社會吸納(na)就業(ye)能力(li)。

1.降低和(he)簡化部(bu)分(fen)行業(ye)(ye)就業(ye)(ye)條件。一是(shi)推動(dong)取消除道(dao)路危險貨物(wu)運輸(shu)(shu)以(yi)外的(de)(de)道(dao)路貨物(wu)運輸(shu)(shu)駕駛(shi)員(yuan)從業(ye)(ye)資(zi)(zi)格(ge)考(kao)(kao)試,駕駛(shi)員(yuan)可憑《經營性道(dao)路貨物(wu)運輸(shu)(shu)駕駛(shi)員(yuan)培(pei)訓結業(ye)(ye)證(zheng)書》和(he)相(xiang)應(ying)車型的(de)(de)機動(dong)車駕駛(shi)證(zheng)等(deng)證(zheng)件申領道(dao)路貨物(wu)運輸(shu)(shu)駕駛(shi)員(yuan)從業(ye)(ye)資(zi)(zi)格(ge)證(zheng)。二是(shi)按照(zhao)國家(jia)規定(ding)改革(ge)執業(ye)(ye)獸醫(yi)資(zi)(zi)格(ge)考(kao)(kao)試制(zhi)度,允許獸醫(yi)相(xiang)關專(zhuan)業(ye)(ye)高校在(zai)校生報(bao)名(ming)參加考(kao)(kao)試并按規定(ding)取得(de)證(zheng)書。三是(shi)推動(dong)勞動(dong)者(zhe)在(zai)亚博游戏二級及以(yi)上醫(yi)療機構(gou)入職體檢結果實現互認。四(si)是(shi)加快推進(jin)職業(ye)(ye)資(zi)(zi)格(ge)改革(ge),按照(zhao)國家(jia)規定(ding)取消水平評價類技(ji)能(neng)(neng)人員(yuan)職業(ye)(ye)資(zi)(zi)格(ge);全面推進(jin)企(qi)業(ye)(ye)職業(ye)(ye)技(ji)能(neng)(neng)等(deng)級認定(ding)工作,支持企(qi)業(ye)(ye)依據國家(jia)職業(ye)(ye)技(ji)能(neng)(neng)標準自主(zhu)開展技(ji)能(neng)(neng)人才評定(ding),形成以(yi)市場為導向的(de)(de)技(ji)能(neng)(neng)人才培(pei)養使用機制(zhi)。五是(shi)簡化就業(ye)(ye)手續,推動(dong)取消應(ying)屆高校畢業(ye)(ye)生報(bao)到證(zheng)。

2.持(chi)續優(you)化(hua)納稅(shui)(shui)(shui)(shui)(shui)服(fu)務水平(ping)。進一(yi)(yi)步減少企(qi)(qi)業納稅(shui)(shui)(shui)(shui)(shui)環(huan)節(jie)、時(shi)間和成(cheng)本,推動(dong)發(fa)票(piao)辦(ban)(ban)理(li)(li)、申(shen)報(bao)(bao)納稅(shui)(shui)(shui)(shui)(shui)等各(ge)環(huan)節(jie)“全(quan)程(cheng)網(wang)辦(ban)(ban)”。一(yi)(yi)是(shi)(shi)簡化(hua)稅(shui)(shui)(shui)(shui)(shui)收(shou)優(you)惠(hui)政策申(shen)報(bao)(bao)程(cheng)序(xu),將(jiang)全(quan)部稅(shui)(shui)(shui)(shui)(shui)收(shou)優(you)惠(hui)核準(zhun)轉為備案或申(shen)報(bao)(bao)即享,不再(zai)設置審(shen)(shen)批(pi)環(huan)節(jie)。二是(shi)(shi)實(shi)(shi)行(xing)企(qi)(qi)業所得稅(shui)(shui)(shui)(shui)(shui)(預繳)、城(cheng)鎮土地(di)使(shi)用稅(shui)(shui)(shui)(shui)(shui)、房產稅(shui)(shui)(shui)(shui)(shui)、印花(hua)稅(shui)(shui)(shui)(shui)(shui)、土地(di)增(zeng)(zeng)(zeng)值(zhi)稅(shui)(shui)(shui)(shui)(shui)等5稅(shui)(shui)(shui)(shui)(shui)種合并申(shen)報(bao)(bao)。實(shi)(shi)現(xian)增(zeng)(zeng)(zeng)值(zhi)稅(shui)(shui)(shui)(shui)(shui)、消費稅(shui)(shui)(shui)(shui)(shui)和城(cheng)市維(wei)護建設稅(shui)(shui)(shui)(shui)(shui)、教育(yu)費附加(jia)、地(di)方(fang)教育(yu)附加(jia)等合并申(shen)報(bao)(bao)。三(san)是(shi)(shi)優(you)化(hua)增(zeng)(zeng)(zeng)值(zhi)稅(shui)(shui)(shui)(shui)(shui)留抵退稅(shui)(shui)(shui)(shui)(shui)辦(ban)(ban)理(li)(li)流(liu)程(cheng),企(qi)(qi)業網(wang)上納稅(shui)(shui)(shui)(shui)(shui)和退稅(shui)(shui)(shui)(shui)(shui)申(shen)報(bao)(bao)可“一(yi)(yi)表”同步辦(ban)(ban)理(li)(li)。四是(shi)(shi)優(you)化(hua)增(zeng)(zeng)(zeng)值(zhi)稅(shui)(shui)(shui)(shui)(shui)發(fa)票(piao)審(shen)(shen)批(pi)服(fu)務,對于連續辦(ban)(ban)理(li)(li)發(fa)票(piao)增(zeng)(zeng)(zeng)版(ban)(ban)增(zeng)(zeng)(zeng)量(liang)業務且符合實(shi)(shi)際(ji)經營(ying)狀況(kuang)的企(qi)(qi)業,實(shi)(shi)行(xing)發(fa)票(piao)智能實(shi)(shi)時(shi)審(shen)(shen)批(pi),及時(shi)為其調整發(fa)票(piao)核定數量(liang)或版(ban)(ban)面,切(qie)實(shi)(shi)滿(man)足企(qi)(qi)業合理(li)(li)的發(fa)票(piao)使(shi)用需求(qiu)。五是(shi)(shi)進一(yi)(yi)步擴(kuo)大“非接觸式(shi)”辦(ban)(ban)稅(shui)(shui)(shui)(shui)(shui)繳費服(fu)務范圍,實(shi)(shi)現(xian)全(quan)部涉稅(shui)(shui)(shui)(shui)(shui)政務服(fu)務事項“網(wang)上辦(ban)(ban)”,主(zhu)要(yao)涉稅(shui)(shui)(shui)(shui)(shui)政務服(fu)務事項“掌上辦(ban)(ban)”。六是(shi)(shi)積極(ji)開(kai)展(zhan)增(zeng)(zeng)(zeng)值(zhi)稅(shui)(shui)(shui)(shui)(shui)專用發(fa)票(piao)電子(zi)化(hua)試點,在集貿市場(chang)全(quan)面推行(xing)代開(kai)增(zeng)(zeng)(zeng)值(zhi)稅(shui)(shui)(shui)(shui)(shui)電子(zi)普通(tong)發(fa)票(piao)。

(六)營造更(geng)加規范的監(jian)管執法(fa)環境

加強政府(fu)監管(guan)頂層設計(ji),實行分級分類監管(guan)。建(jian)立以信用為基礎的(de)監管(guan)制(zhi)度,完善(shan)“雙隨(sui)機、一公開(kai)(kai)”監管(guan),持續推進“互聯(lian)網(wang)+監管(guan)”和跨部門協同監管(guan),加快構建(jian)權責明(ming)確、公平公正(zheng)、公開(kai)(kai)透(tou)明(ming)、簡約高效的(de)事(shi)中事(shi)后監管(guan)體(ti)系。

1.大力推動“雙(shuang)隨(sui)機(ji)、一(yi)公(gong)開”監(jian)(jian)(jian)(jian)管(guan)(guan)全覆蓋(gai)。一(yi)是除特殊行業、重點領域(yu)外,按照(zhao)不同風(feng)險級別開展“雙(shuang)隨(sui)機(ji)、一(yi)公(gong)開”監(jian)(jian)(jian)(jian)管(guan)(guan),大幅壓(ya)減檢(jian)(jian)查(cha)(cha)次(ci)數(shu)。二是按照(zhao)“誰(shui)審批誰(shui)監(jian)(jian)(jian)(jian)管(guan)(guan)、誰(shui)主管(guan)(guan)誰(shui)監(jian)(jian)(jian)(jian)管(guan)(guan)”的原則(ze),繼續擴大“雙(shuang)隨(sui)機(ji)、一(yi)公(gong)開”監(jian)(jian)(jian)(jian)管(guan)(guan)實施范圍(wei),各(ge)部門(men)涉企“雙(shuang)隨(sui)機(ji)”檢(jian)(jian)查(cha)(cha)事(shi)項覆蓋(gai)率不低于(yu)90%。三是進一(yi)步拓展部門(men)聯(lian)合(he)“雙(shuang)隨(sui)機(ji)、一(yi)公(gong)開”監(jian)(jian)(jian)(jian)管(guan)(guan)覆蓋(gai)范圍(wei),制定第(di)二批跨部門(men)聯(lian)合(he)抽查(cha)(cha)事(shi)項清單,將各(ge)部門(men)檢(jian)(jian)查(cha)(cha)頻次(ci)高、對(dui)企業干擾大且適(shi)合(he)合(he)并的檢(jian)(jian)查(cha)(cha)事(shi)項全部納入跨部門(men)聯(lian)合(he)抽查(cha)(cha)范圍(wei)。

(七(qi))營造更(geng)加公(gong)平公(gong)正(zheng)的法治保障環境

建立以法治(zhi)為基(ji)礎的保(bao)障制(zhi)(zhi)度,提高審判執行(xing)質效,加(jia)大知識產權(quan)保(bao)護力度,加(jia)快完善仲(zhong)裁制(zhi)(zhi)度,依法保(bao)護各(ge)類市場主體合(he)法權(quan)益。

1.強化民(min)商(shang)事(shi)案(an)件司法(fa)保(bao)障。圍繞調解、取證、鑒定、審(shen)判(pan)(pan)、執(zhi)行(xing)等關鍵環節,著力提(ti)升司法(fa)效(xiao)率。一(yi)是(shi)進一(yi)步深化民(min)事(shi)訴(su)訟繁簡分流改革(ge)試(shi)點工(gong)作(zuo),力爭簡易程(cheng)序及(ji)小(xiao)額訴(su)訟程(cheng)序適(shi)用(yong)率達到80%。二是(shi)建立涉(she)外(wai)商(shang)事(shi)多(duo)元解決糾(jiu)紛中心,實(shi)現涉(she)外(wai)商(shang)事(shi)案(an)件公(gong)證、調解、仲裁(cai)“一(yi)站(zhan)式”服務(wu)。三是(shi)發揮疫(yi)情期間(jian)建立的(de)“云法(fa)庭”作(zuo)用(yong),鼓勵在全(quan)市法(fa)院推行(xing)網上審(shen)判(pan)(pan)。四是(shi)支持法(fa)院擴大民(min)商(shang)事(shi)案(an)件二審(shen)獨任制(zhi)適(shi)用(yong)范(fan)圍,對事(shi)實(shi)清楚、法(fa)律(lv)關系明確的(de)案(an)件,二審(shen)可由(you)1名法(fa)官審(shen)理,進一(yi)步提(ti)升案(an)件審(shen)判(pan)(pan)效(xiao)率。五是(shi)支持法(fa)院進一(yi)步規范(fan)執(zhi)行(xing)行(xing)為,嚴(yan)格控(kong)制(zhi)執(zhi)行(xing)工(gong)作(zuo)各環節時(shi)間(jian)節點,嚴(yan)禁超標查封,最(zui)大限度減小(xiao)執(zhi)行(xing)工(gong)作(zuo)對企(qi)業正常運營影響,切實(shi)維(wei)護企(qi)業家(jia)合法(fa)權益。

2.建立(li)完善企(qi)業破(po)(po)(po)產(chan)制度。一是(shi)(shi)支(zhi)持法(fa)(fa)院建立(li)涉(she)眾(zhong)型破(po)(po)(po)產(chan)案件(jian)提前會商機(ji)(ji)(ji)制,研究建立(li)破(po)(po)(po)產(chan)企(qi)業職工(gong)(gong)欠薪保障(zhang)機(ji)(ji)(ji)制。二(er)是(shi)(shi)發揮府院聯動(dong)機(ji)(ji)(ji)制作用,制定(ding)關聯企(qi)業實質合并破(po)(po)(po)產(chan)規(gui)則(ze),簡化(hua)破(po)(po)(po)產(chan)程(cheng)序、降低破(po)(po)(po)產(chan)企(qi)業處置(zhi)成本。三是(shi)(shi)出臺破(po)(po)(po)產(chan)企(qi)業不(bu)動(dong)產(chan)處置(zhi)容缺辦(ban)(ban)理(li)(li)(li)規(gui)范,進一步明確(que)規(gui)則(ze)、標準、程(cheng)序,提高財產(chan)處置(zhi)效(xiao)率。四是(shi)(shi)鼓勵法(fa)(fa)院設立(li)破(po)(po)(po)產(chan)管(guan)理(li)(li)(li)人(ren)考核委員會,出臺考核工(gong)(gong)作規(gui)范,建立(li)定(ding)期考核機(ji)(ji)(ji)制。在市、區(qu)兩級(ji)政務服務大廳設立(li)破(po)(po)(po)產(chan)事(shi)項窗(chuang)口,為破(po)(po)(po)產(chan)管(guan)理(li)(li)(li)人(ren)辦(ban)(ban)理(li)(li)(li)業務提供便利。五是(shi)(shi)支(zhi)持法(fa)(fa)院加強辦(ban)(ban)理(li)(li)(li)破(po)(po)(po)產(chan)案件(jian)的(de)法(fa)(fa)官和破(po)(po)(po)產(chan)管(guan)理(li)(li)(li)人(ren)培訓(xun),提升辦(ban)(ban)理(li)(li)(li)破(po)(po)(po)產(chan)案件(jian)的(de)專業化(hua)水平。

3.加(jia)(jia)強知(zhi)識產(chan)(chan)權保(bao)護。一(yi)是推動研(yan)究制(zhi)訂北京市知(zhi)識產(chan)(chan)權保(bao)護與促(cu)進條例,健(jian)全職務(wu)科技成果賦權、海外維(wei)權等(deng)(deng)各類(lei)(lei)知(zhi)識產(chan)(chan)權保(bao)護機制(zhi)。二是建立知(zhi)識產(chan)(chan)權失信主體“黑名單(dan)”制(zhi)度(du),對重(zhong)復侵權、故意侵權的企業進行(xing)公示,對嚴重(zhong)失信主體,在政府采購和(he)(he)招標(biao)(biao)投(tou)標(biao)(biao)領域進行(xing)限制(zhi)。三是強化市場主體責(ze)任,加(jia)(jia)大對制(zhi)售假冒偽劣、侵犯(fan)知(zhi)識產(chan)(chan)權等(deng)(deng)違法犯(fan)罪行(xing)為的發現和(he)(he)懲處力度(du),對直接關系人民(min)群眾身體健(jian)康和(he)(he)生命安全的領域,加(jia)(jia)快推出懲罰(fa)性(xing)賠償和(he)(he)巨(ju)額罰(fa)款等(deng)(deng)制(zhi)度(du);制(zhi)定知(zhi)識產(chan)(chan)權案件類(lei)(lei)型化裁(cai)(cai)判賠償規(gui)則,參考第(di)三方(fang)評(ping)估合理(li)確定知(zhi)識產(chan)(chan)權損失標(biao)(biao)準。四是擴大知(zhi)識產(chan)(chan)權保(bao)護中(zhong)心服務(wu)范圍(wei),增加(jia)(jia)商標(biao)(biao)、地理(li)標(biao)(biao)志申(shen)請(qing)受理(li),專利侵權行(xing)政裁(cai)(cai)決,仲裁(cai)(cai)和(he)(he)訴訟遠(yuan)程立案業務(wu),提(ti)升(sheng)知(zhi)識產(chan)(chan)權申(shen)請(qing)、糾紛解決的效率。

4.提升商事仲(zhong)(zhong)(zhong)裁(cai)專業化和(he)(he)國(guo)際(ji)化水平。一是擴大(da)(da)仲(zhong)(zhong)(zhong)裁(cai)領域(yu)對外(wai)開放(fang),允許境外(wai)知名仲(zhong)(zhong)(zhong)裁(cai)機構經登(deng)記(ji)備(bei)案,在(zai)特(te)定區域(yu)設立業務(wu)機構,為國(guo)際(ji)商事、投資等(deng)領域(yu)發生的爭議提供(gong)仲(zhong)(zhong)(zhong)裁(cai)服務(wu)。二是研(yan)究出臺境外(wai)仲(zhong)(zhong)(zhong)裁(cai)機構在(zai)用(yong)房(fang)、人(ren)員出入境和(he)(he)停(居)留、外(wai)匯賬(zhang)戶開設等(deng)方(fang)面便利化舉措。三(san)是大(da)(da)力(li)推廣(guang)“互聯網+仲(zhong)(zhong)(zhong)裁(cai)”,完善仲(zhong)(zhong)(zhong)裁(cai)辦案管理系(xi)統,拓展網上開庭、網上送(song)達功能,提高仲(zhong)(zhong)(zhong)裁(cai)效(xiao)率。

三、組織保障

(一)強化(hua)組(zu)織領導(dao)。完善(shan)市(shi)(shi)區兩級(ji)優化(hua)營商(shang)環(huan)境(jing)(jing)工作(zuo)(zuo)推進機(ji)制,固化(hua)亚博(bo)游戏國家營商(shang)環(huan)境(jing)(jing)評價組(zu)織機(ji)制,形成主管市(shi)(shi)領導(dao)統籌領導(dao)、牽(qian)頭部(bu)門(men)和責任部(bu)門(men)共(gong)同推進的工作(zuo)(zuo)格局。各部(bu)門(men)要(yao)結合各自職責,加(jia)強協同配合,一體化(hua)推進相關(guan)領域改革(ge)。要(yao)加(jia)強營商(shang)環(huan)境(jing)(jing)專班建設(she),配齊配強工作(zuo)(zuo)力量,抓好各項改革(ge)任務落地。

(二(er))完善長效(xiao)(xiao)(xiao)(xiao)機(ji)(ji)制。建(jian)立(li)(li)健(jian)全政(zheng)策評(ping)估(gu)(gu)(gu)制度,以政(zheng)策效(xiao)(xiao)(xiao)(xiao)果(guo)評(ping)估(gu)(gu)(gu)為重點,建(jian)立(li)(li)重大政(zheng)策事(shi)前(qian)、事(shi)后評(ping)估(gu)(gu)(gu)長效(xiao)(xiao)(xiao)(xiao)機(ji)(ji)制。加強(qiang)營商(shang)環境(jing)(jing)工作考(kao)核(he),通過(guo)采(cai)取“四不兩直”、明察(cha)暗訪、委托(tuo)第三方(fang)專業(ye)機(ji)(ji)構等多種(zhong)方(fang)式,對(dui)各級(ji)政(zheng)務(wu)服(fu)務(wu)大廳進行(xing)不定期考(kao)核(he),并將結果(guo)納入績(ji)效(xiao)(xiao)(xiao)(xiao)管理(li)。建(jian)立(li)(li)國家評(ping)價(jia)、世(shi)行(xing)評(ping)價(jia)、區級(ji)評(ping)價(jia)相銜接的一體(ti)化(hua)評(ping)價(jia)指(zhi)標(biao)體(ti)系,開展(zhan)分領域(yu)營商(shang)環境(jing)(jing)評(ping)價(jia)。及時(shi)總結推廣優化(hua)營商(shang)環境(jing)(jing)的經驗做法,確保改革(ge)取得實效(xiao)(xiao)(xiao)(xiao)。

(三(san))加強政(zheng)企(qi)溝(gou)通。充分發(fa)揮專(zhuan)家咨詢委員會(hui)、社會(hui)監(jian)督員和政(zheng)務(wu)(wu)(wu)(wu)服(fu)務(wu)(wu)(wu)(wu)“體驗員”作用,建立常態(tai)化信息溝(gou)通渠(qu)道,進(jin)一步(bu)增強改(gai)革的科學性(xing)、針對(dui)性(xing)和有效性(xing)。以12345企(qi)業(ye)服(fu)務(wu)(wu)(wu)(wu)熱線為(wei)基礎,對(dui)企(qi)業(ye)訴求“接訴即(ji)辦(ban)”,按規(gui)定(ding)時限協調解決市場(chang)主體問題建議,提(ti)升(sheng)服(fu)務(wu)(wu)(wu)(wu)企(qi)業(ye)水平。開展“一把手走流程(cheng)”活動,各區、各部門要進(jin)一步(bu)查找辦(ban)事流程(cheng)中存在的問題,不斷改(gai)進(jin)服(fu)務(wu)(wu)(wu)(wu)。發(fa)揮企(qi)業(ye)“服(fu)務(wu)(wu)(wu)(wu)包”機(ji)制作用,主動服(fu)務(wu)(wu)(wu)(wu)、熱情(qing)服(fu)務(wu)(wu)(wu)(wu)、靠前服(fu)務(wu)(wu)(wu)(wu),構(gou)建親清政(zheng)商關(guan)系。

(四)發揮法(fa)治引領和保(bao)障(zhang)作用。落實好《優化營商(shang)環境(jing)條(tiao)例》,鞏固(gu)已有(you)改革成效。以國家(jia)營商(shang)環境(jing)創新(xin)試點城(cheng)市建設為(wei)契機,積極向國家(jia)有(you)關部門溝通匯報推(tui)動相(xiang)關法(fa)律法(fa)規調(diao)整實施(shi),授權(quan)亚博游戏開展先行先試,將(jiang)行之有(you)效并可長期堅持的做法(fa)逐步上升為(wei)制度規范,以法(fa)治手(shou)段維護公平競爭環境(jing)。

(五(wu))抓好惠(hui)企政(zheng)(zheng)策(ce)(ce)(ce)(ce)(ce)兌現。各(ge)區、各(ge)部門要(yao)梳理(li)(li)公布惠(hui)企政(zheng)(zheng)策(ce)(ce)(ce)(ce)(ce)清單,根據企業需(xu)求(qiu)精(jing)準(zhun)推送政(zheng)(zheng)策(ce)(ce)(ce)(ce)(ce),各(ge)區出臺惠(hui)企措施時要(yao)及(ji)時公布相(xiang)關負(fu)責人(ren)及(ji)聯系方式。大力推行(xing)惠(hui)企政(zheng)(zheng)策(ce)(ce)(ce)(ce)(ce)“免(mian)申(shen)即享(xiang)、線上兌現”,通過政(zheng)(zheng)府(fu)部門信息共(gong)享(xiang)、大數據應(ying)用等(deng)方式,實現符合(he)條件的企業免(mian)予申(shen)報、直接享(xiang)受政(zheng)(zheng)策(ce)(ce)(ce)(ce)(ce)。對于政(zheng)(zheng)府(fu)專項(xiang)(xiang)資金補貼、重點項(xiang)(xiang)目(mu)支持等(deng)確需(xu)企業申(shen)請的惠(hui)企政(zheng)(zheng)策(ce)(ce)(ce)(ce)(ce),要(yao)合(he)理(li)(li)設置并公開申(shen)請條件,簡化申(shen)報材料、辦事流(liu)(liu)程(cheng),邀請行(xing)業協會商(shang)會等(deng)機構圍繞惠(hui)企政(zheng)(zheng)策(ce)(ce)(ce)(ce)(ce)申(shen)請流(liu)(liu)程(cheng)、操作指南(nan)等(deng)開展(zhan)政(zheng)(zheng)策(ce)(ce)(ce)(ce)(ce)解讀,加(jia)快(kuai)(kuai)實現“一次(ci)申(shen)報、全程(cheng)網辦、快(kuai)(kuai)速(su)兌現”。

(六)廣泛(fan)開展宣(xuan)傳培訓(xun)。各(ge)區、各(ge)部門要主動發布和(he)解讀改革政(zheng)策,及時總結(jie)宣(xuan)傳改革做法和(he)經驗,為(wei)企業、群(qun)眾(zhong)查詢和(he)掌握政(zheng)策創造便利(li);要進(jin)一(yi)步加強政(zheng)務(wu)(wu)服務(wu)(wu)大廳建設,廣泛(fan)開展“小小窗口,滿滿服務(wu)(wu)”專項行動,不(bu)斷(duan)提高一(yi)線工作人員的服務(wu)(wu)意(yi)識和(he)業務(wu)(wu)水平。
